By downloading or using Diabetes Hacker ("the App"), you agree to these Terms of Service. The App is provided by Viral Builders.
We grant you a limited, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, subject to these Terms and the Apple Licensed Application End User License Agreement.
You agree not to:
Diabetes Hacker is not a medical device. The App is an informational logging and tracking tool. It does not diagnose, treat, cure, or prevent any disease, and it is not intended to be used to make medical or treatment decisions.
The glucose values, trends, arrows, graphs, and any alerts the App shows are pulled from your connected CGM service — either Dexcom Share or Abbott LibreLinkUp (FreeStyle Libre). We do not generate, measure, validate, correct, or guarantee these numbers. We display what the CGM service sends us, exactly as we receive it.
The numbers in this App may sometimes be delayed, incomplete, or inaccurate, so please don't treat them as the final source of truth for your health.
This can happen for many reasons, all of which are outside our control, including but not limited to:
Always verify before you act. Before making any decision that could affect your health, confirm the reading against the official app for your CGM — Dexcom's official app or receiver, or Abbott's FreeStyle LibreLink app — and when in doubt, a fingerstick blood glucose meter. Treat the official CGM app or receiver — not Diabetes Hacker — as the authoritative source. Do not rely on this App, or on the absence of an alert in this App, to detect a high, low, or any urgent glucose event.
To the maximum extent permitted by law, Viral Builders is not responsible or liable for any glucose value or other data that is inaccurate, delayed, missing, or wrong for any reason, or for anything that results from you relying on data shown in the App. You use the displayed data at your own risk.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR ACCURATE.
To the maximum extent permitted by law, our total liability for any claim arising out of the App is limited to the amount you paid us for the App (zero, since the App is free). Under no circumstances are we liable for any health-related decisions or outcomes resulting from your use of the App.
If you connect a CGM service, your interactions with that service are governed by its own terms of service and privacy policy — for example, Dexcom's policies (if you use Dexcom Share) or Abbott's policies (if you use LibreLinkUp / FreeStyle Libre). Viral Builders is not a party to your relationship with Dexcom, Abbott, or any other CGM provider.
We may update these Terms. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of California, USA.
If your use of Diabetes Hacker — including any health decisions you or anyone else makes based on what the App shows — causes a third party to bring a claim against Viral Builders, you agree to defend, indemnify, and hold harmless Viral Builders and its officers, members, employees, agents, and licensors from and against any such claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees). We may take over the defense ourselves at our option, and you'll reasonably cooperate.
Please read this carefully — it changes how disputes between you and Viral Builders are resolved.
(a) Binding individual arbitration. Any dispute, claim, or controversy arising out of or relating to the App or these Terms will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, in Los Angeles County, California, or by remote/video hearing. Either party may still bring an individual claim in small-claims court.
(b) No class actions. You and Viral Builders agree that any arbitration or proceeding will be conducted only on an individual basis. NO CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTIONS ARE PERMITTED.
(c) Jury trial waiver. Both parties waive any right to a jury trial.
(d) 30-day opt-out. You may opt out of this arbitration agreement by emailing viralbuildersllc@gmail.com within 30 days of first accepting these Terms, including your name, the app, and a clear opt-out statement. The remainder of these Terms will still apply.
(e) Exceptions. Either party may bring a court action to enjoin infringement or other misuse of intellectual property rights.
Apple distributes Diabetes Hacker through the App Store but is not the provider of the App. The following terms are required for App Store distribution:
Viral Builders is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, network outages, third-party service failures (including Dexcom, Abbott, Apple, or any cloud provider), changes in third-party APIs, governmental actions, or labor disturbances.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms — together with the Privacy Policy and Apple's Licensed Application End User License Agreement — constitute the entire agreement between you and Viral Builders regarding the App.
